Terms and conditions of the educational game “DEGRADATOR”

These terms and conditions for the use of the “DEGRADATOR” Application (hereinafter referred to as the “T&C”) govern the relationship between the User and the International Institute of Molecular and Cell Biology in Warsaw and constitute an agreement for the provision of electronic services (hereinafter referred to as the “Agreement”).

- Definitions
Whenever the T&C mention:
- IIMCB – this should be understood as the International Institute of Molecular and Cell Biology in Warsaw, a state organizational unit based in Warsaw, ul. Ks. Trojdena 4, 02-109 Warsaw, NIP 5262278704, REGON 013082798;
- User – this should be understood as a natural person who uses the Application;
- Application – mobile or web application enabling the use of the educational game “DEGRADATOR”;
- Civil Code – this should be understood as the Act of April 23, 1964, Civil Code (consolidated text Journal of Laws of 2023, item 1610, as amended);
- Act on the provision of services by electronic means – this should be understood as the Act of 18 July 2002 on the provision of services by electronic means (consolidated text Journal of Laws of 2020, item 344);
- Code of Civil Procedure – this should be understood as the Act of November 17, 1964 (consolidated text Journal of Laws of 2023, item 1550, as amended).
- General provisions
- The T&C define the rules for the User’s use of IIMCB services in the form of an Application developed and/or published by IIMCB.
- The use of the Application is also subject to the Privacy Policy, which constitutes Appendix 1 to the T&C.
- The Application may be used only on the terms and within the scope specified in the T&C.
- It is prohibited to use the Application in a manner that violates the law, decency, personal rights of third parties or legitimate interests of IIMCB.
- If it is found that the User engages in activities prohibited by law or the T&C, violating the principles of social coexistence or detrimental to the legitimate interests of IIMCB, IIMCB may take any actions permitted by law, including restricting the User’s access to use the Application and the services provided through it.
- The condition for using the Application is to agree to the T&C and the Privacy Policy.
- By installing the Application on a mobile device or starting to use it in a web browser, the User agrees to the T&C.
- The content of the T&C is available at the IIMCB headquarters, in the Application and on the website https://degradator-gra.pl/.
- All rights to the Application and the materials contained therein, including copyrights and intellectual property rights to its name and logos, belong to IIMCB or third parties and may only be used in the manner specified in the T&C.
- The contract is concluded for an indefinite period upon approval of the T&C.
- The User may stop using the Application at any time by deleting it from the mobile electronic device in a standard manner for a given version of the operating system or stop using the web application.
- Technical requirements
- In order to use the Application, the User should meet the following technical requirements:
- connection to the Internet – to download the Application to a mobile electronic device and to use the functionalities of the Application that require a connection to the Internet;
- having a mobile electronic device running on the Android operating system version 13 or higher;
- in case of using the web version of the Application, it is recommended to use the current version of the Google Chrome web browser.
- In order for the Application to function properly, it is required to use the latest version of the update.
- IIMCB is not responsible for any problems resulting from the use of devices or operating systems that do not meet the requirements described above.
- IIMCB will make every effort to ensure that access to all functionalities of the Application is provided 24 hours a day, 7 days a week, which does not exclude IIMCB’s right to order a technical break related to a failure or the need for maintenance, modernization or reconstruction of the Application and to temporarily limit or disable all or part of the above-specified access.
- IIMCB is not responsible for non-performance or improper performance of services by telecommunications operators with which the User has concluded contracts.
- IIMCB is not responsible for the lack of operation or incorrect operation of operating systems necessary to run the Application, as well as software other than the Application, installed or downloaded to the User’s mobile electronic device.
- In order to use the Application, the User should meet the following technical requirements:
- License
- Upon conclusion of the Agreement, IIMCB grants the User a license to use the Application. The license is non-exclusive and territorially unlimited. The license expires upon termination of the Agreement. The license to use the Application is free of charge.
- The license authorizes the User to use the Application, without the right to grant sublicenses, in the following fields of use:
- entering the memory (including RAM) of a computer or mobile device,
- saving in memory and displaying on this computer or mobile device,
- temporary reproduction in the memory of a computer or mobile device, necessary to use the Application.
- Violation of the license terms by the User entitles IIMCB to terminate the Agreement with immediate effect.
- Personal data
- Detailed information regarding the collection and processing of personal data is regulated by the Privacy Policy, which constitutes Annex 1 to the T&C.
- Final Provisions
- The Agreement is terminated:
- at the User’s initiative when deleting the Application from the mobile device;
- on the initiative of IIMCB in the cases specified in the T&C or at the time of deletion of the Application or termination of the provision of services related to the Application.
- The T&C have been prepared in two language versions – Polish and English. In case of discrepancies, the Polish version shall prevail.
- In the event of changes to these T&C, the User will be informed about them via the Application. The date of entry into force of the changes cannot be shorter than 14 days from the date of their announcement.
- These T&C are valid from February 1, 2024.
- The User may report any irregularities related to the functioning of the Application and other reservations in writing to the e-mail address indicated in the introduction to the T&C.
- In the complaint, the User should provide data enabling his/her clear identification, correspondence address, as well as the nature and date of the identified irregularities and other reservations. IIMCB will respond to the content of the submitted complaint within 14 days.
- The User and IIMCB undertake to amicably resolve any disputes. If the User and IIMCB are unable to reach an agreement, any disputes arising between them will be submitted to a court of competent jurisdiction in accordance with the principles arising from the Code of Civil Procedure.
- In matters not regulated by the T&C, the provisions of Polish law shall apply, in particular, the provisions of the Civil Code and the Act on the provision of services by electronic means.
