End-user license agreement for the educational game “DEGRADATOR” valid from March 15, 2024

PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY.

This end user license agreement (hereinafter referred to as the “EULA”) sets out the terms of use of the Degradator Application, related enhancements, overlays, updates and related services, both within the mobile application and the web application, including additional educational materials created under the Grant Agreement, provided by the International Institute of Molecular and Cell Biology in Warsaw.

  1. Definitions

Whenever the EULA mentions:

  • Application – mobile or web application enabling the use of the educational game “DEGRADATOR”;
  • Google Play – a service provided by Google Ireland Limited, based at Gordon House, Barrow Street , Dublin 4, Ireland;
  • Grant Agreement – this should be understood as the agreement of December 22, 2022 No. SONP/SP/546507/2022, concluded between the State Treasury – Minister of Education and Science and the International Institute of Molecular and Cell Biology in Warsaw, the result of which is, among others, the Application;
  • IIMCB – this should be understood as the International Institute of Molecular and Cell Biology in Warsaw, a state organizational unit based in Warsaw, ul. Ks. Trojdena 4, 02-109 Warsaw, NIP 5262278704, REGON 013082798;
  • User – this should be understood as a natural person who uses the Application;
  1. General provisions
    • The application contains code, graphics, music and texts created by IIMCB. All elements indicated in the previous sentence are the property of IIMCB. At the same time, in accordance with the Grant Agreement, IIMCB granted the Minister of Education and Science a free, non-exclusive license to use the Application, without restrictions as to territory, for information and promotional purposes.
    • The application was made using software that allows for the connection and joint operation of all its elements (the so-called game engine) belonging to Scirra Ltd, based in London, UK. Scirra Ltd., as the licensor of IIMCB, may benefit from the protection of its rights in the event of any breach of the EULA in a manner related to the license agreement between it and IIMCB. Any reproduction or representation of such licensed material by any technique for any purpose is prohibited without the prior consent of IIMCB and, where applicable, the consent of Scirra Ltd.
    • By installing the Application on a mobile device or starting to use it in a web browser, the User agrees to the EULA.
    • The content of the EULA is available at the IIMCB headquarters, in the Application and on the website https://degradator-gra.pl/.
    • The Agreement is concluded for an indefinite period of time upon approval of the Terms and conditions by the User.
  1. Grant of limited rights
    • Upon approval of the Terms and conditions by the User, IIMCB grants the User a free, non-exclusive and territorially unlimited license to use the Application.
    • The license authorizes the User to use the Application, without the right to grant sublicenses, in the following fields of use:
      • entering the memory (including RAM) of a computer or mobile device,
      • saving in memory and displaying on this computer or mobile device,
      • temporary reproduction in the memory of a computer or mobile device, necessary to use the Application.
    • The User agrees and understands that the rights granted in point 3.1 and 3.2 are not assignable or transferable to any third party.
  1. Additions to the Application or its modifications
    • IIMCB may modify the Application in the future to change it, expand functions, add content and fix errors.
    • The modified Application will be provided free of charge.
    • IIMCB reserves the right to provide the User with a modified version of the Application and is not obliged to provide the User with such a modification.
  1. Application in mobile version
    • To use the mobile application, the User must have an account and log in to Google Play. The User’s use of Google Play and its applications and games or other digital content or services is subject to the Google Play Terms of Service and the Google Terms of Service. Google Play is a service as defined in the Google Terms of Service.
    • When using Google Play, the User is obliged to comply with the terms of use of the Google Play service and the terms of use of Google services referred to in point. 5.1 above.
    • IIMCB is not involved in and disclaims liability for the User’s use of Google Play. If it is necessary to contact the Google Play-related matter, the User is obliged to contact the provider of this service.
    • Using the mobile version of the Application is possible in all countries where the use of Google Play is allowed.
  1. Restrictions on use

The Application User is prohibited from performing the following activities:

  • The User may not use the Application to promote false information, disinformation, conspiracy theories, unscientific events or other forms of disinformation that may harm the community or mislead other users.
  • The application may not be used for commercial purposes without the express consent of IIMCB. The User may not use the Application to promote or advertise, in particular, but not limited to, pharmaceutical companies and products, unless he obtains permission for such activities from IIMCB.
  • Without the express consent of IIMCB, the User may not use any elements of the Application, such as graphics, music or texts in other projects, applications or media that are not related to the use of the Application itself. IIMCB reserves that it consents to the use of the elements of the Application indicated in the previous sentence for educational purposes, among others by teachers and educational institutions. Educational goals include, among others, conducting lessons and activities supporting the learning process.
  • Intentionally exploiting errors or problems when they occur in the Application.
  • Interfere with or disrupt any content or functionality provided by the App.
  • Any similar activities that may be harmful to IIMCB, in accordance with the content of each preceding provision.
  1. End of an agreement
    • The User may terminate this EULA at any time by uninstalling the Application from its mobile device or discontinuing the use of the web version of the Application.
    • The EULA terminates automatically if the User does not comply with its terms.
    • IIMCB may terminate the EULA by terminating the provision of services related to the Application.
    • IIMCB reserves the right to terminate the EULA without notice and in its sole discretion upon violation of 1 (one) or any number of provisions of this Agreement. In such a case, the User is obliged to immediately uninstall the Application from the mobile device or stop using the web version.
  1. Disclaimer
    • The User expressly acknowledges that uses the Application at its own risk.
    • To the fullest extent permitted by applicable law, the product is provided “as is” and “as available” without warranty of any kind, unless IIMCB expressly states otherwise.
    • IIMCB is not responsible for any damage resulting from the use of the Application.
    • IIMCB makes every effort to ensure that the Application is available all the time, but does not guarantee the availability of the Application all the time or that any faults will not occur.
    • The User assumes all responsibility for the selection of the Application for its specific purposes and for the installation, use and results obtained through the Application.
  1. Final Provisions
    • IIMCB reserves the right to unilaterally amend the EULA at any time at its sole discretion by displaying such amendment on the website https://degradator-gra.pl/.
    • The EULA was prepared in two language versions – Polish and English. In case of discrepancies, the Polish version shall prevail.
    • If any provision of the EULA is determined to be unlawful, void or for any reason unenforceable, such provision will be deleted to the minimum necessary extent and its deletion will not affect the validity and enforceability of any remaining provisions.
    • Any irregularities related to the functioning of the Application and other concerns may be reported by the User in writing to the e-mail address indicated in the introduction to the EULA. In the complaint, the User should provide data enabling his/her clear identification, correspondence address, as well as the nature and date of the identified irregularities and other concerns. IIMCB will respond to the content of the submitted complaint within 14 days.
    • The User and IIMCB undertake to amicably resolve any disputes. If the User and IIMCB are unable to reach an agreement, any disputes arising between them will be submitted to a court of competent jurisdiction in accordance with the principles arising from the Code of Civil Procedure.
    • In matters not regulated by the EULA, the provisions of Polish law shall apply, in particular, the provisions of the Civil Code and the act on the provision of electronic services.
